    My guess is that he didn't appear to be impaired so it would be very hard to get a conviction. There is no device that instantly detects the level of THC in your bloodstream like a breathalyser would do for alcohol and, as far as I know, drivers aren't required to submit to a blood test or hair sample test.

    I also don't know if Missouri law defines specific limits for THC that would qualify as "under the influence" or "intoxicated" like the levels that are set for alcohol.

    I know in California and Hawaii, you have to submit to either a field sobriety test or a blood test for alcohol. I am assuming the same is the case for THC, so they may be able to force you to have a blood test (not really forced, because by signing for your drivers license, you are agreeing to those stipulations). Ive only spent one night in Missouri, so I have no idea what the laws are there.

    In Ct you can refuse a field sobriety test but doing so buys you a 6 month license suspension. As Topeka mentioned I am not aware of any field device that tests for THC. I think that the only "field methods" for testing for being high on weed are the old "walk the line", "touch your fingers to your nose" or "recite the alphabet backwards" methods.

    I hate to say it, but we are all guilty of allowing DB's arrest to distract us from the real business at hand....beating the thrice-damned donks. Hope our team is doing a better job of ignoring this distraction than we are.

    Grew up in Riverside, med school at UCLA and got stationed in 29 Palms for awhile. Im stationed in Hawaii now (it's my reward for putting up with 29 Palms for 2 years).

    No more "hall passes" for DB. If he wants to remain a Chief he needs to show the potential he is supposed to have.
